Can Vampires Enter Homes if the Owner is Dead?

I was just wondering this earlier, and I wanted to see what everybody else thought.
Say, for example, that there was a home that had only one owner. If a vampire killed that man, the house wouldn't have an owner, and would, technically, be public property. Do you guys think that this would happen?

I don't know that it was ever brought up on BtVS, but on AtS it is mentioned more than once that a vampire can enter the home when the owner is dead. It was actually a bigger plot device in a couple of Angel episodes.

Well Spike, Dru & Angelus could enter the Mansion, so that's an example from BTVS 🙂

Yeah, there was actually an episode of Angel where Kate the Cop's dad was drained by vampires and Angel couldn't save him because he didn't have an invite into the apartment. Once the man was dead Angel was able to enter and stake the vamps.

Then the rapist-for-hire in Angel season 2 who died, and Angel, who was leaning towards the invisible barrier, fell through it when the guy supposedly died. Very funny scene.

Yes... Once an owner is dead, or if the owner abandons the house, such as the house we see Spike walking into in Season 7's "Empty Places", the vampire can enter the house without an invitation.

There's also an incident in Five by Five where Faith beats up and puts a person in the hospital, then stays in his apartment, yet when Angel goes after her he can enter without any invitation.

It should be noted that the guy who Faith mugged in the beginning of the episode is referred to as being in critical condition in the hospital, however, Angel still manages to enter his apartment without being invited. This is in stark contrast to the episode Untouched from season two in which Angel enters the apartment only after the owner has died. However, it is possible that this could be explained by Faith's comment during her confrontation with Angel in his office when she told him that he had an 'open invitation' to confront her; Faith may have spent enough time in her victim's apartment to acquire 'squatter's rights' that would allow her to offer an invitation (Much like Cordelia was able to invite Angel into her apartment before she actually had it). I buy it. He could have pretended to be a copand who didn't have time ti get a warrant or something, said he needed to know where he lived and, pretending to be a cop, asked for permission to enter. Or, he threatened the guy.

I do love the scene in Untouched when Angel is leading against the banner when the guy dies and he is able to enter. 🙂
