Casey Anthony

I don't know much about the case, I've heard only the facts, and from what I've heard.. she seems guilty. Many people seem to think so. I don't see where's justice there, if she is guilty.
 
I actually can't put too much thought into this case because the whole idea of it actually makes me a little physically ill. My tummy goes all blech.

I can only hope that she wasn't guilty, since she got off. And that maybe, eventually they will find who did this.

I'm sick over this. This woman clearly murdered that baby and got away with it. What mother in her right mind, who loved her child, would go 30 days without reporting her child missing? That poor baby... Our justice system failed.
 
I graduated law school, so here's how the system works in criminal cases...

The prosecution must prove beyond a reasonable doubt that the defendant committed the crime. In other words, if there is any shred of doubt in a juror's mind that the defendant was not guilty, then they should not convict that person.

Casey Anthony was charged with capital murder, aggravated manslaughter, and aggravated child abuse (along with providing false information). Based on the evidence, it would be tough for the prosecution to prove capital murder. They couldn't prove the how, the why (motive), and the when. There was no direct evidence (DNA, fingerprints, etc). And the circumstantial evidence provided (her actions and behavior) would be hard to infer she was guilty because the intent element is critical for capital murder.

Now, based on the circumstantial evidence, the jury could have inferred that she was guilty, especially for manslaughter and child abuse (the lesser charges). In other words, the jury could have found beyond a reasonable doubt that she was guilty of being reckless and negligent with her child. Yet, I think because there was no witness who said Casey was a bad parent before Caylee was murdered hurt the prosecution's case. So, again, that reasonable doubt may have been in the jury's mind.

Both attorneys did their job (although I think the prosecution could have done a much better job litigating). And if she's really guilty, karma will find her.

There is a reason they wanted a jury rather than have it tried by a judge alone.

I have never tried a jury case. I practice Family Law, and we don't have juries. But that jury was whack.

As a parent, I have "lost" my son for a short time (we all have). He was about 30 minutes late, and I was freaking. He came in, apologized, and then I realized it was time to get him a watch. lol

How do you go 30 days without calling the cops, etc etc etc etc? If you didn't kill you kid, you don't!!!!! There was no doubt she was guilty.

The problem is you have the "hot" factor. Yep, she's hot (not Willow hot, of course), and no jury is going to send a "hot" defendant to death row until there is a confession, or it was witnessed by the Pope. DUH!!!

Yeah it sounded like she was guilty. Like seriously, she googled how to make homemade chloroform and how to snap a neck.

Although it does sound like the prosecution didn't do a very good job, (I don't know allot about it), but saw a news report which said they left allot out, witnesses and stuff.

What's even crazier is that she was offered a job as a porn star, like wouldn't you hate to be the one at the meet that suggested that, thinking it I can understand thinking it but actually suggesting it without thinking people will call you an idiot or worse.
 
What I find especially strange, is that the defense didn't do that great of a job-

Their main case was Caylee drowned in a pool. But she was found with THREE layers of an obscure brand of duct tape found in the Anthonys' home wrapped around her head.
It doesn't work for me. I mean, how did that duct tape get there if she drowned?

HOWEVER, I guess I can see, that Casey had a lot of things going for her:
She was able to lead the police around in circles with her lies.
And her mother, Cindy, tampered with A LOT of the evidence.

I also feel like she should of AT LEAST gotten a greater sentence, like maybe the fact she claims she let her kid get drowned? :/

She totally got away with murder. I hope she can live with herself after what's she's done. I think they proved WAY beyond a doubt that she killed her daughter. Who waits to report their child missing until a month later and parties it up while she's missing?! A few HOURS, and my mom would have been a nervous wreck.

There's a special place in Hell for people like her.

Yep.... it was me!

My son and I were watching Buffy or Angel, and they used chloroform. So we googled it. It seemed like a "miracle." You just put it over their mouth... and poof!! We learned it isn't exactly used like it is in the movies.

Of course that's just a little piece, of course. And there was a ton of other evidence. And she's still guilty.

I have tried many, and I have very little faith in juries, except that I do believe that they think they are trying to do the right thing.

But that jury was whack.

That said, I simply cannot agree with this. According to the rest of your note, your main evidence that Casey killed Caylee was her not reporting the child missing for 30 days. When I first started paying attention to this case (which was only a few days ago) that's what I thought too. I would have FREAKED if thirty-one SECONDS went by that I didn't know where my two-year old son was.

But, unfortunately for justice, Casey's neglect was also consistent with her crazy story, that Caylee drowned and she panicked and dumped her in the woods and then, because of her degree of emotional distress, partied for thirty days.

Mind you, I'm not buying it. I would have voted to convict.

But I've (very reluctantly) come to the point where I can understand why the jury thought there was reasonable doubt. The fact that she didn't report the child missing for 31 days is simply not enough for a murder conviction.

Personally, I'm positive that she did it and that she got away with murder. IMO poor Caylee was killed by the very person who should have been willing to give up her life for the child.

But I've finally come to understand that maybe the system DID work. If there's not enough evidence to prove someone guilty beyond a reasonable doubt, then they should be acquitted, even if our gut tells us they are guilty. I want to see people convicted, and their freedom (or their life) taken away, because of hard evidence, not gut feelings.

Well I live in Florida and after hearing about this for so long I am annoyed with the verdict. The way that woman acts is just ridiculous to me.
I can understand not giving her the death penalty but I mean no child abuse? It is just crazy. All the lies she told and everything it is just one big mess. It was definitely an OJ situation imo. It is going to suck when she is back to her partying ways.

Overall she is a horrible person and well I hope she can make it in the real world because people are pretty ticked about this whole thing.
 
I have not read into the case much, so I can't really tell you if she was guilty. If the evidence wasn't there, then the jury can't be to blame.

Who knows what really happened. Well, the only one who knows what really happened is Casey Anthony. If she, in fact, murdered her own child and had any shred of sanity in her then she will deeply regret it.

I saw on the news that lawyers were publicly celebrating the fact that Anthony was not guilty. Like the newscasters were saying: In the end a baby died. Celebration in this time is very shallow.

Oh, It's just a sad story and it worries me.

I agree entirely with this.

The jury was so oblivious to the fact that innocent or not, Casey neglected her child for 31 days. That is what makes me the most angry with the jury. I understand the claims against the evidence, and okay, while I feel pretty strongly that she did it - how in the world she isn't going to be prosecuted for 31 days of neglect is my main sadness with this trial. I don't know any parent that would be okay with not knowing where their child is for one day... let alone a month. She should go to jail for a very long time for this reason alone.

It makes me angry that someone could buy drugs or steal and get more time than someone that abandoned their baby.

What makes me even more pissed is that once this is said and done, Casey is going to be rich from book & movie deals. And in a few years when that money is spent she could turn up and say she did it and there is nothing that could be done.

I understand that's obscene. I understand that this woman, IMO, got away with murder and one of the reasons that she did so is that she successfully concealed the murder for so long. But that doesn't change the fact that we convict people in this country based on evidence and the evidence just wasn't there. That makes me sadder than I can say, knowing that the person who should have been willing to die for her child did just the opposite instead.
 
I haven't really been keeping up with the news on this case because the details of the case are a little too difficult for me to deal with. I'd rather not hear about it 24/7. Some part of me wonders whether the outcome would've been the same if the trial hadn't been so publicized though.

Great post!! I've got a touch of insomnia, so I'll put my lawyer hat on for a few......

I still think the jury was wrong, but I wasn't there. I wasn't sequestered, I wasn't removed from the court room during certain proceedings, etc.

As a solo, it is a HUGE undertaking to take on the State. The State has unlimited resources. It was a David vs. Goliath battle (although I hate calling Casey Anthony "David.") I've had a few major battles with the State regarding child support, and it is crazy. They have unlimited lawyers, staff, and research attorneys in Sacramento.

It may not be the best system, but it's better to let one go free than to execute an innocent person. And perhaps the State did a terrible job presenting their case, and they were the ones who allowed a killer go free, not the jury. Perhaps their decision to make this a capital case was a mistake.

Yeah I'm aware of that. I just think it's terrible that they virtually ignored that no parent in their right mind would not be aware of their child for that long a time and she's not getting ANY sort of punishment for that.

And I do agree that this is what seems to of happened.
 
I hope for her sake she is innocent. I echo [MENTION=10790]Goby[/MENTION]'s sentiments that it is better to let a guilty person walk free than to persecute an innocent (wo)man. I can't believe she is guilty because I have a hard time comprehending how anyone would be capable of doing something like that. With the evidence that was presented to them, I think that the jury made the right decision. That's not to say I think the justice system in the US is a great system; I believe it's a very flawed and unfair institution. Any outcome would have been just as tragic and controversial though.

I know that I can't judge her though. I'm not her maker, I wasn't there, and I don't know her. I only know what has been shown to me by the media (not that the media isn't perfect). I know that in this country someone is innocent until proven guilty, not the other way around. The media convicted her long before her trial, and therefore I can't trust them to not be biased. All I can do is pray for her sake she couldn't be capable of something like she has been accused of doing.
