Okay let's say Buffy got Warren in prison, how many years would he had gotten for all of his crimes he's done

That very bannable named punk would never had ened up in jail
He would have died ether by his own cowardness or someone would have done him in that thing had no life just an experation date

Well, considering that he went to Buffy's house with the intention of murdering her, and then proceeded to shoot and kill an innocent girl and shoot Buffy herself, there's not really a dispute about motive or anything like that.

He wouldn't have gotten any years in prison. He would have been sentenced to death for first degree murder. Under California law, that's a capital crime if I've ever seen one.

Not a chance. He would have been recruited by the CIA to make sexbot assassins and provide totally discrete,,,recreation... for any top executives that might require it on a totally discreet basis.

Yeah, death penalty for one count of premeditated murder/ 1st degree murder and one count of 2nd degree murder.
Actually there would be 3 murder charges. It would be 2nd degree murder for killing his ex-girlfriend, attempted first degree murder for trying to kill Buffy and 1st degree murder for the killing of Tara.

I think it would have been 2nd degree murder for Katrina, attempted murder and wounding for Buffy and manslaughter for Tara. Tara would not have been murder because he was not trying to kill her, nor was he even aware that he killed her until he was told by Rack that the witch was after him. Not sure about California law, but possession of a firearm and discharging a firearm within city limits may be other crimes.

Most states have a doctrine called Transferred Intent where in murder cases if you accidently kill a bystander while attempting to commit 1st degree murder your intent is transferred from intended victim (Buffy in this case) to the bystander that actually you did kill(Tara.)

Neat point but does not change the fact Warren was a dead man walking

You think Giles would let someone get away with what he did? Theres a thought..

Well probably not, but the thread is about how much jail time Warren would get if he lived. I was just giving my opinion.

tec I did wonder if a normal prison would be able to hold him or any of the Trio if they really wanted to get out. I'm imagining an Arkham type situation.

True but you think Warren would have served that sentance?
The funny twisted thing is they would think it was cool to be an an Arkham type thing
Cos we all know how well that place keeps its wackos is check

I think he would have found a way to break out through magic or something within a week no matter how long he was sentenced 😛

There have been people that have raped, tortured, and murdered and only gotten a handful of years in prison.

Sometimes someone can get 20 years in prison for tax evasion or other white collar crimes while violent sadists are out on good behavior in 3-5 years.

It can depend on the judge, the jury, how good the lawyer is, how the criminal comes off to people, the testimony of the victims or witnesses or surviving loved ones, how much remorse they think the criminal feels, etc.

Does it matter?
So, he would have been given the death penalty for what he did, but his defence team would have appealed on the grounds that ' a voice in his head told him to kill '. He was waiting for an appeal date when he got a visit from (dark) Willow.

Hahahahah
Wolfram and Hart lawers get the appeal go to tell Warren the good news and and find a pile of ash where he once stood

I doubt Warren could afford Wolfram and Hart. The only mortals they seem to represent are corrupt CEOs (sorry for the redundancy) and mob bosses.
