Jail?

I've read a lot of posts by mean people saying they think Willow should go to jail for what she did 🙁. wtf? I didn't hear anyone complaining when Giles killed Ben (although I wasn't posting here when that ep occurred). And Ben was innocent. There's no way a jail could have held Warren for long, he was a genius and proficient with magic. He would have just escaped and killed more people.

Am I right, or am I just looking for excuses?

i think the difference between Giles and Willow is Willow murdered for vengeance and with a slight sense of arrogance.Giles did what had to be done.and didn't enjoy it or revel in it like willow did.

But enjoying it doesn't make it a crime. And as I said, I think Warren would have easily escaped any normal jail.

Buffy said that they don't mess with humans, they have their own rules and jail, and that they only deal with the vampires and paranormal stuff, or something to that effect, remember? Well, in my opinion, Warren had crossed over from the regular society into the paranormal-district of the law.

He made an invisibility gun, can brainwash people, and has many many spells at his disposal, he even made rocket pack thingos. He was a genious.

Do you agree that he couldn't have been brought to justice by normal law, because he was too smart and could escape?

Or do you think that he could have been held by a normal prison for the rest of his life?

whether she enjoyed it or not it was still a crime in the real world.her motives weren't to stop warren harming others it was vengeance pure and simple.who is willow but a friend of the slayer who through an extreme need to control events around her got too far into dark magics.why do you believe she has the right to be judge/jury/executioner?

I don't. I never said that.

All I said is that she should not go to jail.

If that was a crime, then Giles killing Ben was too.

so is it just jail or punishment per se you're opposed to?jail is probably inappropriate for willow, could it hold her.would you be opposed to a watchers' council type imprisonment?
ben was only half human?warren was all human?maybe.the reason willow deserves punishment and giles doesn't is motive.

Why should motives matter? If the police had walked in and saw Giles killing Ben, then they wouldn't have cared what was happening. They would still arrest him. I don't think Willow should go to jail for her actions. And I agree, jail is an inappropriate place for her to learn from her mistake. There should be some sort of punishment, but jail shouldn't be it.

Punishment is supposed to teach people a lesson. I'm opposed to all revenge or 'deserve it' motivated actions. Does Willow need to be taught anything?

Willow was severely disturbed by watching a loved one get murdered right in front of her, then she was tainted by the dark magicks she absorbed. Could you say she went insane? Or that the event and these magicks detached her human emotions from her temporarily?

I think that we can argue that Giles killed Ben/Glory in self-defense. Remember Ben wasn't a normal person per se...Glory inhabited his body, and in order to get rid of Glory, he had to get rid of Ben. Willow's motive was clearly revenge...

i have to say i dont really think warren was a 'normal' person either
psycho guy would be closer to the truth
unfortunately this is Willow we're talking about here and the dark majiks fully took her over is what i got from this whole thing
which is how the 'majiks' form giles fought with her majiks rather than with her if you know what i mean and then good won out
so it was more like the magic took on all willlows feelings
i dont know if im making sense to you all
but what im really trying to say is that no i dont think will should go to jail because i dont believe she was of 'sound mind and body' whne the crime was being committed
and really it could be self defense
i mean we know he was coming after the slayer and her friends and he did throw all that stuff at her granted that was kinda in his own defense to but stll he was hardly blameless

Katie
sorry about the extreme bable factor but my thoughts get all mixed about this

On the more pragmatic side, who's going prove Willow killed Warren and how? Magic? (Ha! It doesn't exist.) Torture? (A bitty little thing like her?) It's a tough one for the court system...

I think it's yet another thing that's going to have to be left as a matter of conscience rather than a matter of law.

They'll probably dismiss Willow for this because the town seems to just forget the super-natural things that go on in town.

those are the most valid points thhat have been made so far
the town of sunnydale wont believe it
so how can they prosecute her for it

Well, you have witnesses. Secondly, you can reach a logical conclusion. Tara gets killed. Willow, Tara's lover, tries to kill Andrew and Jonathon(who are Warren's partner's in crime) and Warren is never seen from again. I know what you are nowthinking-- how can you prosecute without a body? There have been many successful cases in real life where a good prosecutor has won murder convictions without a body...

Double Post: -

In addition, Warren was a human who just happened to be real smart. It is totally irrelevant whether or not he dealt in magic. Are you saying that real magicians who should commit a crime be treated like a demon and slayed?

But will the witnesses speak up? (We'll find out in Season 7). Andrew and Jonathan were last see fleeing the country; will they still be too terrified of Wiliow to return? (We *might* find out in Season 7.)

Warren's mother will eventually report him as a missing person, no doubt. But given all his hideouts during his Troika activities, it may take her a while to notice, by which time the trail could be cold.
Also, given Warren's age, brains, ambition, and utter lack of consideration for other people's feelings, wouldn't it seem more likely that he's just taken off for (and disappeared into) some Big City to make his fortune without bothering to say goodbye? (I imagine both his mother and the overworked police force would prefer this scenario to a grisly murder.)

Just some thoughts...

Whoa!! Do you think that the Scoobie gang is going to be so forgiving to her? Especially that she attacked all of them, and tried to kill Giles...I mean look what happened to Angel...Just because Willow "cursed" him again, didn't mean everyone was rallying to hang out with him...She is going to have to do alot of grovelling(and more than just a month). I suspect that one or more members of the Scoobies are going to are going to be a little bit more...sensitive around Willow now...

Good question. It'll undoubtedly be different for each Scooby. But being unforgiving isn't necessarily the same thing as being willing to rat her out to the police. (Not to mention the difficulties in explaining to the police exactly what she did...)

Yes, if they are likely to hurt more people. Because no Jail can actually hold these people for a long time. It must be extremely easy to escape with the knowlege that Warren had.
