The real issue here is that there's an expectance to come to a conclusion on whether he should stay in there or not, when we are absolutely oblivious as to the effect that nearly forty years in prison has had on his mindset. Are his opinions still the same? Forty years is a lot of time to change. Would he even be able to function outside of prison after his sentence?

Perny! Seriously?! Did ya take a dose of the mean and crazy pills today? First of all I think you may be direly underrating what a 70-something has the ability to do. He's not on his death bead or disabled in any way... he fully still IS a threat, especially because as others have said, the main source of his power rested on his ability to get others to do his dirty work. And also, oh freaking well if he wants to spend his remaining days free and he "knows what not to do" while back in the population! What he WANTS matters not even a little bit, what he DESERVES is to stay right where he is until he takes his last breath.
