Speeding Ticket - Any chance?

My best friend's x-step father is stalking her, her mother, and I. He was physically and mentally abusive towards both of them until they kicked him out of the house. Since then he has been stalking us very badly. He leaves notes on the front door that say, "If you date another man I'm going to kill both of you." He calls the house at 3AM and asks, "Why is the door locked and the shades down?" He circles both their work, as well as the house, for hours and hours on end. He'll wait for them in dark areas so he can corner them and scare them. He even follows me. He's followed me to school, from her house, from my other friend's house, coming home from the store. He's even tried to run my car off the road. All we can do is file complaints because the law is stupid. They've gotten two provisional restraining orders against him, but each time they go for the final one it gets dropped.

Tonight we were coming home from CVS and we passed by one of the bars in town. He must have seen us pass by and he flew out of the parking lot and started to come after us. He was seriously almost hitting the car and swirving all over the place, clearly drunk. When someone who was abusing you for 7 years, and then started stalking you, is drunk and angry and comes after you in a car what do you do? You go faster! So, we're flying down the street going 60mph in a 25. He saw the popo (cop) before we did and turned down a side street. My friend was starts to slow the car down when the cop used his radar and saw us speeding. He pulled her over and gave her a ticket. Since she was going over double the speed limit, and she has her provisional license, she has to go to court in a month and it may be taken away.

My question is: Given the background of who was behind us, do you think she has a fighting chance in court and won't loose her license?
 
I just think because first the law is stupid as you said, and second you would have to proove that he was behind you and that you were in danger..... And unless you have a picture or something it wil be kind of difficult...

But I'm no lawyer so... maybe...

Surely death threats constitutes breaking the law. If he keeps hasseling you after breaking a restraining order you must be able to do something about it. I would think it was an arrestable offence.

If not you're right. The law is stupid.

I say it won't hurt to explain the reason behind the speeding. They should at least listen to it.

both restraining orders were dropped so now he wasn't violating anything, but there's still records of them obviously
What you need to do is try and find some evidence that he was chasing you, and putting your life in Danger.
Firstly check with the bar that he came put of, if they have a camera in their car park and see if you can get video Prof of him rushing out of the car park, this wont prove that he was chasing you put it would be a good start.
Next try and find any other place along the route he chased you to see if they have camera's, maybe one of those speeding camera could have caught something?

we already checked with the bar. they don't have a working camera in the parking lot. and it was a public street so there wouldn't be cameras anywhere else.
IF you can;t prove he was following you the chances are very much against you. You can try explain it anyway, and if its a first time offense they may let her off easier, maybe take it away for less time or not all all, but the chances are slim. Its worth a shot anyway though.

Do you have a X-Coper company in your town? It's a group of cops who offer their services to help you get info on a matter like this. They will also accompany you for your court appearence.
