Is Hollywood's #MeToo movement poised for a very public letdown?

On the eve of Harvey Weinstein's pivotal pretrial hearing on Dec. 20, the New York criminal case against the mogul looks to be on much shakier ground than in the court of public opinion, legal experts say.

"This is the prosecutor's worst-case scenario," says criminal defense attorney Mark Geragos, citing a series of setbacks in recent weeks in which Weinstein lawyer Ben Brafman undermined the credibility of the New York police department, the grand jury process, and the three women who accused the disgraced producer of rape and sexual assault.

The prosecution suffered its biggest blow in October when Judge James Burke tossed a count involving allegations made by Lucia Evans, one of the original accusers in Ronan Farrow's New Yorker exposé, who said Weinstein forced her to perform oral sex on him in 2004. Evans' grand jury testimony was thrown out because an NYPD detective failed to pass along information to prosecutors that contradicted the former actress' account.

In a previous motion, Brafman claimed that Assistant District Attorney Joan Illuzzi-Orbon was given information that would contradict Evans' testimony, and "it was the prosecutor who unethically withheld this information from the Grand Jury and it is they who are now lying to the Court." Perhaps most controversial, Brafman also presented a series of emails to Weinstein from accuser Miriam "Mimi" Haleyi, who wrote endearments like "Miss you too," "Lots of Love" and "xxxxx" in the years after a 2006 encounter in New York in which she says she was sexually assaulted by the producer.

Attorney Alan Dershowitz, who was brought on by Brafman as a consultant, says there are more emails the defense plans to present as exculpatory evidence, even as lawyers for accusers complain about the strategy out of confidentiality concerns.

“You can’t both accuse someone publicly and then hide behind privacy to keep highly relevant evidence out,” says Dershowitz. “The evidence I’ve seen doesn’t embarrass anyone. It suggests a loving relationship that seems fairly commonplace. For people who say, ‘This is the way that people behave [after an assault] and you can’t make judgments on these things,’ well that’s for the public to judge and for courts to judge.”

Dershowitz adds, “I believe that if a grand jury and the public were to see these emails, they would come to a very different conclusion about what happened. The emails show consensual relationships between Weinstein and his accusers both before and after the alleged crimes allegedly occurred.”
 
Well hopefully when the metoo thing peters out this angry backlash against it will too. Like, I think there's more hatred towards feminism and people who say they were assaulted, than before. So hopefully as a society we can go back to dismissing them rather than shouting them down and having outright anger towards them.
As a cynical person that's the best outcome.
 
The thing is Me Too in itself was never going to be enough to change things it was merely a starting point. A statement. This whole mess with the courts just shows how backwards the whole system is. It's basically saying a trial can't go forward because someone didn't tick a box on a form. That is madness!
 
He may be a brilliant legal mind but Mr.Alan is a prince stereotype of the amoral lawyer. Everyone deserves a fair trial but not every one gets what they deserve thats for sure.

@Bluebird , Yes the same way studies of hate and extremism show monthly hate crime was higher in the 90s, with a small uptick after 9/11 and a remarkable decline since and another uptick in November 2016. I think we can reasonably predict a uptake of misogyny as well. I haven't the furthest clue what to do about feminism used as a scapegoat, retrograde sexism usually follows totalitarian crises but what to do with the fact giving a name to a womens movement allows for it as a rhetorical target, I don't know maybe its a redherring because women would be targeted regardless.

Back to Harvey, he may end up not having been convictable but the issues at play with assault prosecution needs to addressed. I won't be arguing with people on here who think the current system is adequate. This isn't any where near a Kavanaugh thing, there are fundamental flaws with the current justice system when rape casee make to trial in the first place, stastically seeing a courtroom puts him at the odds, particularly with the wealth and power he possessed. Its a outliner and representative at the same time.

His lawyers perpueted a lot myths about sexual assault victims and how they should behave. I want to this addressed on daytime TV and Cable news, thats a lot more valuable then "O.J" style shouting matches.

I don’t think Alan Dershowitz is amoral. I think he cares about going by what the law actually says.

I wonder if any litgation could come from Harvey's espionage and why it hasn't yet.

If he ever paid people to lie for him and his where abouts? If he ever impersonated or threatened people? or maybe people are still afraid of his money and favors if he has stuff on others.

Thing is there are so many allegations against him at this point you would think something somewhere along the line would stick. What we can probably say with some certainly is that his movie career is over. That's no bad thing.

Eh. Maybe, maybe not.

Any system when there is a gatekeeper to a film succeeding or when people have to play games to get ahead is not a good system for me. No matter what can be proven against Weinstein. There's little doubt he's crooked.

But it's not just affecting one person though. It affects over a hundred people in direct employe, not to mention the countless other careers through the various projects. Understand that it's good that one potential predator is out of power, but it does affect many other lives and livelihoods. That's not necessarily a good thing.

That's the funny thing about allegations. They're usually something to be proven. Hence the term, "allegation."
 
We should have anonymity for everyone until after a criminal case has concluded. Stops false accusations ruining careers, stops juries being influenced before a trial and generally stops wild speculation.

It was affecting livelihoods anyway. Going by what former employees have said about what it was like working for him, I doubt they'll be too upset. I'll wager most of them will be relieved not to have to be around that monster again:

And as for associated projects, there are plenty of other production companies (with muhc more amicable Execs at the helm) looking to take on new work so all that industry talent has a good chance of finding work - and with much better creative partners.

Oh no, there's no denying he was a dick. That's well established. Hell, even Entourage mocked him for it. But his company also took on and produced many movies others passed on. Movies they still will pass on.

I do not see how that would be feasible or even wanted in a democracy, its worthy news. France however has a policy of the accused having a right to privacy which means no photographs in handcuffs, whether your a petty criminal or high ranking CEO etc cetera they were scandalized when a french politican was arrested and photographed in handcuffs in America after being accused of assaulting a hotel maid. Or is it name with held as well? any ways, not saying we must imitate necessarily, only so used to our norms such a difference in thought had not occurred to me. "Juries being influenced" is a great point for high profile cases. Reportage after the fact is of course fair game.

Thinking more about it though, what if after a none guilty verdict and the public interest in a case never having been aroused in the first place, means a decreased interest in general, which is arguably "good" without "spectacle" but without Jude Judy and cameras in court rooms and without documentaries etc this might have a stultifying effect meaning reforms don't get passed, when we definitely could use reform, cases do not get reviewed, precedents are not as respected. I mean North America is about the spectacle in a way but the flip side of that is good cause America is a place that forces change.
 
If Weinstein had had a hit in the last five years, Hollywood never would have let him be arrested and everyone would have closed ranks and said that anyone who charges a successful man with sex crimes will never work in this town again. If you are going to behave like Weinstein, you have to keep the hits coming or this could happen to you.

What do you call a hit? Lion, released in 2016, had an 85% Tomato meter and a 91% audience score.
The Hateful Eight, released in 2015, had a 74/76.
Carol, released in 2015, had a 94/73.

I would say those are three hits in the last three years. They just aren't "blockbuster" hits, but Weinstein is not blockbuster production company.
