Stealing art and selling it, tricking DVD customers!!

The piece on the Buffy cover is Zugma's and I reported it to her... I also sent an email to the company to complain to them about it. I don't know how much good it will do, but I hope she at least gets some sort of royalty from the sales.
 
^^ Actually, I think the guy/company who owns the seperate images should sue the crap out of that company.

It looks real, anyone think they actually ordered lots of packages and put the ordinary seasons in them and then took a photo.
 
I wish Zugma would sue. That poor girl has been ripped off, especially with that particular BtVS piece, SO many times. 🙁
 
That is a fantastic price on your second link. I am thinking about ordering from there. That is the one with the extra 40th disc right?

That's Not Right, IMO, If They Are Going To Use Other People's Art (For a DVD/CD cover) Then They Should Credit and Pay The Artist
 
But if Zugma asked for royalities, wouldn't bea crime as well? She doesn't own the SMG, JM an DB images, does she? Or the background? If she tried to make money from it, she would be just as bad as these guys. Of course, I'm no laywer, maybe I misunderstood the law.
 
Zugma does not give ANYONE permission to post her art or use it anywhere, so that is not the issue. I emailed the company and got some BS response back that pretty much tells me that a) either the company didn't even read what I sent, or b) they don't care if they might get sued for using the art.
 
*sigh* Before I even clicked the link I knew it would be the Zugma piece, it is easily the most ripped off piece of fan art around. You see it EVERYWHERE! This is nothing, FX UK were using it to advertise Buffy. They just had the image of her with the sword but they still just lifted it from Zugma's piece.

Yeah, my jaw literally dropped when I saw that on FX last year. I was astounded they'd be so stupid.

Completely agree, and like Kean said - you see that picture everywhere. People have no shame, just ripping her off like that.

What's not the issue? I can't disagree about Zugma's right to sue? There can't be two "issues"?

It's not the issue because that's up to the owners of those pictures and whether or not they wish to sue Zugma

And HisMrs clearly pointed out the Zugma should sue for wrongful usage of her work. The work is still hers. Then if the WB or whoever owns the pics of SMG etcetera would decide to pursue lawsuits as well than it would be a completely different lawsuit and has nothing to do with the Zugma vs these DVD-guys
 
I created the thread so i figured that I could create as many issues as I want, specially if it is disgareeing with posts in the thread.

I guess I don't get the copyright law. I assumed it was fine to create artwork from pictures that aren't yours, like we all do, but not to make money from it, since we don't own the pictures we use. I assumed Zugma didn't have the right to sue because she didn't own the original pictures.

Yup, this image is everywhere!! Even my sis (she made me a whedon' type calender for me' and she also stole this pic. I was like 'omg' you can't steal people's art like that!
haha she must of been like 'ungrateful bitch' lol.
It's a shame. :/
 
I always see that pic on google and I love it. I always wanted it as a poster, but I guess it's a good thing I never did it.

I've seen official sites that have used this piece too. Hell, before I understood what art theft was, I think I chopped it up and made a banner out of it. It's the best piece of fanart I've ever seen. If you look on EBay, there are items all over the site with this piece on them, too. 🙁

That's not what I meant. Of course Zugma could sue if she wanted to. But since the pictures she used in the art are are not hers, she can't really do that without having to pay the WB/CW some royalties, too. :\ It's probably one of the reasons she doesn't sue people for use of this piece.

I think you're getting way offended because you misunderstood me when I said "that is not even the issue". Of course sueing them IS an issue.

Like I said before, if Zugma sued them for use of this pic, then the WB/CW could easily sue her for use of the picture, too. That's the thing that makes art theft such a sad situation. As artists we work our asses off on pieces to make beautiful works of art, but we're not allowed to make money from the pieces because the pictures we use to do them aren't our own (unless we purchase them of course). So when we see sites like this one stealing someone piece, it's sad 'cause we really have no right to sue them, since the pics weren't really ours to begin with.

The second post you quote wasn't directed towards you.
I actually went to Zugma's site and found this post about why she can't sue people for their use of her artwork... It's a good read, and explains why people shouldn't take other people's fanart.
 
And that's why she doesn't sell any merchandise herself- I wondered about that, but of course, she can't! The images she uses are not owned by her.
